Terms of Service

1. Acceptance

By creating an account and using kfrax holidays ("the service"), you agree to these Terms of Service. If you do not agree, do not use the service.

2. The service

kfrax holidays is a personal travel planning tool that lets you organise trips, track budgets, upload photos, and collaborate with travel companions. The service is provided by kfrax (kfrax.com).

3. Your account

• You must provide a valid email address to register.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 16 years old to use the service.
• One account per person. You may not share your account with others.

4. Your content

You own the content you create and upload — trip data, photos, journal entries, and any other material you add to the service. By uploading content, you grant kfrax a limited licence to store and display that content to you and the travel companions you explicitly share it with.

You may not upload content that is illegal, violates third-party rights, or contains malware.

5. Shared trips

When you invite another user to a shared trip, they can view and edit trip data as permitted by their role. You are responsible for who you invite. Trip owners can remove members at any time.

6. AI features

Itinerary suggestions, point-of-interest recommendations, and other AI-generated content are provided for convenience and are not guaranteed to be accurate, complete, or up to date. Always verify travel information independently before making bookings or decisions.

7. Acceptable use

You agree not to:

• Use the service for any unlawful purpose.
• Attempt to gain unauthorised access to other users' data.
• Reverse-engineer, scrape, or abuse the service's APIs.
• Use the service to store or distribute offensive, harmful, or illegal content.

8. Service availability

We aim to keep the service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the service at any time with reasonable notice where possible.

9. Disclaimer of warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be error-free, secure, or fit for any particular purpose. Use the service at your own risk.

10. Limitation of liability

To the maximum extent permitted by law, kfrax shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including loss of data, loss of profits, or any other losses.

11. Termination

You may delete your account at any time via Settings. We reserve the right to suspend or terminate accounts that violate these terms. On termination, your data is deleted as described in our Privacy Policy.

12. Governing law

These terms are governed by the laws of Germany. Any disputes shall be subject to the jurisdiction of the courts of Germany, without prejudice to your rights as a consumer under EU law.

13. Changes to these terms

We may update these terms from time to time. We will notify you of material changes via email. Continued use of the service after the effective date constitutes acceptance of the updated terms.
